CONDITIONS OF ENTRY

  1. Information on prizes and how to enter form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each entrant. Entry must be made via Internet or SMS. Any costs associated with accessing the promotional website remain the responsibility of each entrant and are dependent on the Internet service provider used. Any contact details entered incorrectly on the website shall be deemed invalid and will result in an ineligible entry.
  2. The promotion is only open to Australian residents aged 18 years or older (Eligible Entrant). Employees (and their immediate families) of the Promoter and printers, suppliers, providers and agencies associated with this promotion are ineligible to enter.
  3. The promotion commences at 12:01am (AEDST) on 1st January 2010 and closes at 11:59pm (AEDST) on 14th March 2010 ("Promotion Period").
  4. To enter, Eligible Entrants must, during the Promotion Period, choose a Mobil 1 engine oil lubricant service from a participating car dealer to receive their unique code, then submit their entry via one of the following entry mechanics:

    SMS: text the unique code followed by their name to 197 77 464 (SMS cost $0.55c)

    WEB: go to www.mobil1.com.au, select Promotions & Events and complete the online entry form.

  5. Total number of unique codes printed is 5,000.
  6. Incomplete, ineligible or incomprehensible entries will be deemed invalid. No responsibility will be taken for lost, late or misdirected entries. Entries must be received by the Promoter during the Promotion Period. Entries will be deemed to be accepted at the time of receipt into the promotional database and not at the time of transmission.
  7. A reply text message (SMS) or a notification page (WEB) will be sent to each entrant immediately after their entry as confirmation that their entry has been successfully received. If an SMS entry is not successful because it is not in the required SMS format or the unique code submitted is invalid or has already been used, the entrant will be prompted to submit their entry again. If the entrant elects to resubmit their SMS entry, the entrant will be charged an additional $0.55 cents (including GST). SMS entries must be sent from a mobile phone handset and be identified by a MSISDN (unique mobile SIM number) for security reasons to be eligible. SMS Entrants must have the mobile phone bill payer's permission to enter the promotion or their entry will be invalid.
  8. Multiple entries will be accepted, but on each occasion an Eligible Entrant must fully comply with the entry requirement set out in these Terms and Conditions. Each entry must be based on a separate Mobil 1 engine oil lubricant service from a participating car dealer during the Promotion Period, and each entry must have a separate unique code. Each Eligible Entrant must retain and present proof of purchase in order to claim a prize. In order to be eligible to claim the major prize, the major prize winner will be asked to present proof of purchase for every entry made. If the major prize winner is unable to provide proof of purchase for all entries made, then all the entries of that entrant will be ineligible and deemed invalid. Proof of purchase includes providing a photocopy of the dealer tax invoice for each purchase made.
  9. Entrants can only enter in their own name. The Promoter reserves the right to request the winner to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter's satisfaction, at its sole discretion) in order to confirm the winners' identity, age, residential address, eligibility to enter and claim a prize, and any information submitted by the winner in entering the promotion before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the winning entry has not been verified or validated to the Promoter's satisfaction within the time requested, the winner's entry will become invalid. The prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
  10. Major Prize Draw: The major prize draw will take place at 11:00am (AEDST) on the 15th March 2010 at Oxygen Interactive Marketing, 2-6 Glenferrie Road Malvern VIC 3144. The major winner will be notified by mail and telephone and their name and postcode will be published in The Australian newspaper on 19th March 2010. All reasonable steps to notify the winner of the results of the draws will be taken by the Promoter. Judges' decision is final and no correspondence will be entered into.
  11. The first (1) eligible entry drawn from all entries received during the Promotion Period will win the Major Prize.

    • Presentation of the Blackberry during a Meet and Greet (dress standards apply) with Lewis Hamilton (subject to availability) at the ING Australian Grand Prix over the weekend of March 26th - 28th 2010
    • Invitation to the ING Australian Grand Prix
    • 3 nights twin-share accommodation at the Langham Hotel Southbank
    • For non-Victorian residents only: 2 x return economy airfares from the winners nearest capital city and return airport-hotel transfers.
  12. The total maximum prize value is $3000.00 (inc GST), dependant on winner's state of residence.
  13. MOTORSPORT IS AN UNCERTAIN BUSINESS. SUBJECT TO SCHEDULE, BEST ENDEAVOURS WILL BE MADE TO FULFIL THIS PROMOTION WITH A PRIZE PRESENTATION BY LEWIS HAMILTON. IN THE EVENT THAT LEWIS HAMILTON IS NOT AVAILABLE ALL REASONABLE EFFORTS WILL BE MADE TO SUBSTITUTE ANOTHER VODAFONE MCLAREN MERCEDES DRIVER.
  14. Acceptance of the travel prize is subject to any prevailing terms and conditions of any accommodation/transport/services/transfers or tour providers, and in particular, health, behavior, age and safety requirements. No compensation will be payable to a winner if they are unable to use any element of the prize as stated for whatever reason, including refusal of entry or departure into or out of Melbourne, Australia (as applicable) or participation in certain activities for health, age, behavior or safety reasons. Any part of a prize that is not taken for any reason is forfeited.
  15. In respect of the prize listed in Condition 10, the winner will not accrue any frequent flyer points from taking the prize. All components of the prize must be taken together. Accommodation and travel is subject to booking, accommodation and flight availability. Once booked, any changes made to the booking may incur a cancellation fee or amendment fee, at the cost of the winners. Travel and accommodation is to be arranged by the Promoter and/or a licensed travel agent nominated by the Promoter. The standard of flights and accommodation is entirely at the Promoter's discretion.
  16. In respect of the prize listed in Condition 9, the prize is subject to availability and is for 3 consecutive nights between the dates March 26th 2010 - 28th March 2010. All additional costs incurred whereby the prize winner wishes to make variations to the prize details outlined in condition 9 above, are the winnerÕs responsibility and must be booked separately by the winner.
  17. All other costs including additional meals, additional flights, laundry services, transport to and from departure point, insurance (and any applicable insurance excesses), travel insurance, and all other ancillary costs not expressly provided, as well as obtaining any of these, are the responsibility of the winner. This prize cannot be used in conjunction with any other discounts or special offers. Use of any passes and vouchers issued as part of the Prize are subject to prevailing terms and conditions of use and passes are only valid for use within the stated duration on the passes or vouchers issued or the duration of the winnersÕ holiday, whichever is earlier. Any tickets or passes which remain unused after the completion of the Prize holiday shall be deemed null and void.
  18. The Promoter's decision is final and no correspondence will be entered into.
  19. Prizes must be taken as offered and cannot be varied. Prizes are not transferable or exchangeable and cannot be taken as cash. Any unused portion of the prize is non-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken as cash. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
  20. If the winner cannot be contacted or the winner is ineligible to receive the prize, then the Promoter may conduct such further draws at the same time and location as the original draw on 19th March 2010. In the event of a winner their name will be published in The Australian newspaper on 24th March 2010.
  21. If any prize or any element of a prize becomes unavailable for any reason beyond the Promoter's reasonable control, then a similar prize or prize element of equal or greater value will be awarded to the winner in lieu, subject to any written directions under State or Territory legislation.
  22. The Promoter and its associated agencies and companies shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with using any prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
  23. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Conditions of Entry, or if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  24. any attempt to cause malicious damage or interference with the normal functioning of the SMS applications or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Conditions of Entry or any other legal obligation by an entrant, the entrant agrees to indemnify the Promoter for those losses, damages and costs.
  25. The Promoter is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to entrant's or any other person's mobile handset or computer related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.
  26. If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions under State or Territory legislation.
  27. SMS is not a guaranteed delivery communication tool. The Promoter and the service provider cannot accept responsibility for any SMS messages not received.
  28. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
  29. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.
  30. The winner agrees to participate in all reasonable promoted activities in relation to the promotion as requested by the Promoter and its agents and sign any release document provided by the Promoter, in its absolute discretion. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner of a draw (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  31. All entries and any copyright subsisting in the entries become and remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the promotion. The Promoter also may: (a) use the information to contact entrants in the future with information on special offers or provide entrants with marketing materials via any medium including mail, telephone and commercial electronic messages; and (b) share information with its Australian related companies or promotional partners who may contact entrants with special offers in this way, should you not opt-out of receiving such information. To opt-out, send a reply SMS (charged at standard carrier rates) with the word 'STOP' to the confirmation SMS sent to you if entering by SMS or tick the opt-out button on the online entry form if entering on the promotional website. By entering the promotion, each entrant agrees that the Promoter may use entrantsÕ personal information in this manner. Each entrant also agrees that the Promoter may publish or cause to be published the winnerÕs name and locality in any media. Entrants can also gain access to, update or correct any personal information by contacting the Promoter at the address below. All personal information will be stored at the office of the Promoter. A copy of the Promoter's Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.
